PUBLIC NOTICE

SALE OF CITY PROPERTY

The City of Statesville has received an offer in the amount of $15,000 to purchase an approximately 0.0239-acre parcel located on the southern side of E. Broad St between S. Center St and Cooper St, zoned Statesville Central Business (CB), a portion of PIN 4744-05- 1789.000.

Description

Beginning at a rebar, found at the Northeast corner of Historic Preservation, LLC (DB 3040, Pg 2389) on the southern right of way of E. Broad Street, thence with the right of way of E. Broad Street N 69°50’51” E 20.00’ to a PK Nail Set; thence with the Eastern line of an existing Permanent Easement (DB 513, Pg 23) across City of Statesville (DB 564, Pg 294) S 21°25’11” E 51.84’ to a PK Nail Set; thence S 68°34’49” W 20.00’ to a rebar found at the Southeast corner of Historic Preservation, LLC; thence N 21°25’11” W 52.28’ to the point and place of beginning containing 1,041.15 sq. ft. As shown on a survey by Jordan Grant & Associates, LLC dated 02- 26-2025 having Drawing File: 20250118-Easement-R2.

Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the City Manager at 227 S. Center Street within 10 days after the notice of sale is published (5: 00 PM on May 19th, 2025). At the conclusion of the 10-day period, the City Clerk shall open the bids, if any, and the highest such bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

A qualifying higher bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that offer (i.e., the next offer must be at least $15,800). A qualifying higher bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check. The city will return the deposit on any bid not accepted and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The city will return the deposit of the final high bidder at closing.

Title is to be conveyed by General Warranty Deed, free and clear of any encumbrances, except for a permanent easement and right of way associated with PIN 4744-05-0799.000.

The terms of the final sale include:

1. The offer is tied to the conditions of the sale as laid out in the Offer to Purchase and contract by the City of Statesville and Historic Preservation, LLC.

2. The City Council must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed.

3. The buyer must pay with cash at the time of closing.

4. The bidder is solely responsible for any taxes assessed in 2025.

5. The bidder is solely responsible for all Buyer and Seller costs associated with the sale of the parcel and its advertisement.

6. The Closing shall take place as soon as practicable within thirty days after the Council accepts any bid in open session.

7. The City reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids.
