SALE OF CITY PROPERTY

The City of Statesville has received an offer in the amount of $12,000 to purchase an approximately 1.3-acre parcel located on the northwest corner of Fox Avenue and Dorset Place zoned R-5MF, PIN 4744-62-0910.000.

Description

Beginning on a mag nail found in the western edge of Fox Avenue just east of the curb; thence along Fox Avenue S 05°48’57” W 231.76’ to a computed point north of intersection; thence leaving Fox Avenue N 82°20’28” W 28.65’ to a computed point; thence a curve to the right having a radius of 325.00’ and a chord bearing and distance of N 79°16’07” W 34.88’ to an iron pipe found having coordinates of N 742,698.9263’ E 1,446,060.5844’; thence leaving Dorset Place with the line of Multiple Condo Owners of Berkshires Mark Condo (DB 717, Pg 563) on a curve to the left having a radius of 142.43’ and a chord bearing and distance of N 23°28’48” W 33.29’ to an iron pipe found; thence with the Multiple Condo Owners Property N 31°31’05” W 114.48’ to an iron pipe found; thence N 31°07’52” W 278.22’ to an iron pipe found the southwest corner of Foxcroft Investors, LLC (DB 2439, Pg 1499); thence with Foxcroft N 55°05’39” E 120.61’ to a bent iron rebar found; thence S 31°02’23” E 63.48’ to a bent rebar found at the northwest corner of Cecil F. Privette (DB 2361, Pg 1074); thence with the line of Privette S 28°21’42” E 70.26’ to a square iron pipe found the northwest corner of Norman W. Hope (DB 1535, PG 1074); thence with the line of Hope S 33°25’16” E 82.49’ to a #3 rebar found; thence S 72°13’23” E 94.48’ to a square iron pipe found at back of curb; thence S 67°13’23” E 2.91’ to the point of beginning. Containing 1.304 acres as shown on survey for City of Statesville having Drawing File: 20240303.

Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the City Manager at 227 S. Center Street within 10 days after the notice of sale is published (4: 59 PM on April 15st, 2024). At the conclusion of the 10-day period, the Deputy City Clerk shall open the bids, if any, and the highest such bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

A qualifying higher bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that offer (i.e., the next offer must be at least $12,650). A qualifying higher bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check. The city will return the deposit on any bid not accepted and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The city will return the deposit of the final high bidder at closing.

Title is to be conveyed by General Warranty Deed, “Free and Clear” of any encumbrances.

The terms of the final sale include:

1. The offer is tied to the conditions of the sale as laid out in the Offer to Purchase and contract by the City of Statesville and BVJ Properties, LLC.

2. The City Council must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed.

3. The buyer must pay with cash at the time of closing.

4. The bidder is solely responsible for any taxes assessed in 2024.

5. The bidder is solely responsible for all Buyer and Seller costs associated with the sale of the parcel and its advertisement.

6. The Closing shall take place as soon as practicable within thirty days after the Council accepts any bid in open session.

7. The City reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids.
