Sale of City Property: Parcel located on the eastern side of Lerain Court between Charles Street and Dobson Avenue

SALE OF CITY PROPERTY

The City of Statesville has received the most recent offer in the amount of $21,050 to purchase an approximately 0.17-acre parcel located on the eastern side of Lerain Court between Charles Street and Dobson Avenue zoned R-8M, PIN 4744-30-5007.000.

Description

BEING all of LOTS NOS. THIRTY-EIGHT (38) and THIRTY-NINE (39) of BLOCK “B” OF THE PROPERTY OF C. L. CRUSE as the same is platted, planned and recorded in Plat Book 1, page 77, Iredell County Registry, and being the identical property conveyed to Gadson G. Bigham by deed from Ivory Donaldson and wife, dated August 6, 1953, and recorded in Deed Book 244, page 152, Iredell County Registry.

Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the City Manager at 227 S. Center Street within 10 days after the notice of sale is published (4: 59 PM on April 29st, 2024). At the conclusion of the 10-day period, the City Clerk shall open the bids, if any, and the highest such bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

A qualifying higher bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that offer (i.e., the next offer must be at least $22,153).

A qualifying higher bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check. The city will return the deposit on any bid not accepted and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The city will return the deposit of the final high bidder at closing.

Title is to be conveyed by General Warranty Deed, “Free and Clear” of any encumbrances.

The terms of the final sale include:

1.   The offer is tied to the conditions of the sale as laid out in the Offer to Purchase and contract by the City of Statesville and BVJ Properties, LLC.

2.   The City Council must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed.

3.   The buyer must pay with cash at the time of closing.

4.   The bidder is solely responsible for any taxes assessed in 2024.

5.   The bidder is solely responsible for all Buyer and Seller costs associated with the sale of the parcel and its advertisement.

6.   The Closing shall take place as soon as practicable within thirty days after the Council accepts any bid in open session.

7.   The City reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids.
