Public Notice - Sale of City Property

The City has received an offer in the amount of $35,000 to purchase unaddressed property located along E. Broad Street PIN #4744-36-1897.000.

Property Description

Tract 1: All of Lot No. Six Hundred Sixteen (616) located on the South side of East Broad Street and being known as the "Chipley Property", the same being platted, planned and subdivided by C. A. Stearns as shown on map of record in the office of the Register of Deeds for Iredell County, North Carolina, in Plat Book 2, page 27, and being the identical property conveyed to A. H. Bates, Sr. by deed of Realty Purchase Corporation, dated November 20th, 1945, recorded in Deed Book 174, at page 153, Iredell County Registry.

Tract 2: BEGINNING at a point in the Southern margin of East Broad Street 350 feet Westward from the Southwest intersection of East Broad Street and Cowles Street, said point being also the Northwest corner of the William G. Morris lot, and runs thence with Morris' Western line, South 5 deg. 15 min. East 156 feet to a point in the Nmihern margin of a fifteen (15) foot alley at the Southwestern corner of the said William G. Morris lot; thence with said margin of said alley in a Westerly direction 10 feet to a point at the Southeastern corner of Lot No. 616 of the plat hereinafter referred to, and runs thence with the Eastern line of said Lot No. 616 in a Northerly direction 150 feet to a point in the Southern margin of East Broad Street, being also the Northeastern corner of Lot. No. 616; thence with said margin of East Broad Street, North 71 deg. East 50 feet to the point of BEGINNING. The same being all of Lot No. Six Hundred Eighteen (618) on a plat of the prope1iy of C. A. Stearns recorded in the office of the Register of Deeds for Iredell County, No1ih Carolina, in Plat Book 2, page 27, and being the identical property conveyed to A. H. Bates, Sr. by deed of Realty Purchase Corporation, dated February 2e, 1946, recorded in Deed Book 176, page 575, Iredell County Registry.

The above two tracts being the identical property as conveyed to E. J. Webb, Jr; and wife, Irene B. Webb, by deed of A.H. Bates, Sr. and wife, Vance M. Bates, dated January 24th, 1959, and recorded in Deed Book 312, at page 325, Iredell County Registry.

Upset Bid Process

Persons wishing to upset the offer that has been received shall submit a sealed bid with their offer to the office of the City Clerk within 10 days after the notice of sale is published. At the conclusion of the 10-day period, the City Clerk shall open the bids, if any, and the highest such bid will become the new offer. If there is more than one bid in the highest amount, the first such bid received will become the new offer.

A qualifying higher bid is one that raises the existing offer by not less than ten percent (10%) of the first $1,000.00 of that offer and five percent (5%) of the remainder of that offer.

A qualifying higher bid must also be accompanied by a deposit in the amount of five percent (5%) of the bid; the deposit may be made in cash, cashier’s check, or certified check. The city will return the deposit on any bid not accepted and will return the deposit on an offer subject to upset if a qualifying higher bid is received. The city will return the deposit of the final high bidder at closing.

The terms of the final sale include:

  1. The conditions for the sale as laid out in the offer to purchase and contract by the City of Statesville and Briarstone Ventures, LLC,
  2. The City Council must approve the final high offer before the sale is closed, which it will do within 30 days after the final upset bid period has passed.
  3. The buyer must pay with cash at the time of closing.
  4. The bidder is solely responsible for any taxes assessed in 2023.
  5. The Closing shall take place as soon as practicable within thirty days after the Council accepts any bid in open session.
  6. The property must be built on within twelve (12) months from closing.
  7. The property shall be cleaned up, with overgrowth being cut back within ninety days of closing.

The City reserves the right to withdraw the property from sale at any time before the final high bid is accepted and the right to reject at any time all bids.
